What I think he needs is some kind of assureness that at least one of the original 36 plaintiffs submitted the entry on October 7th or later. If all of them submitted on October 5th or October 6th, he might have a hard time pursuing the 2% strategy for those who sumbitted on October 7th or later and won. The probability of the case that none of those 36 original plaintiffs submitted initial entry on Octobr 7th or later is about 1/2.
